I'm getting a bit fed up with Play. Ordered a remote control Dr Who Davros toy on Friday, today it arrives and the box contains the Sweeney series 1-4! Granted the boxed set is worth £30 more than Davros, but the sheer weight of the box means that the return postage would be around £8-£9, when I emailed about this, they told me they only refund return postage up to £2.50 so if I return it and they send me my correct order. i'd be £7 odd out of pocket!
Ask them to send the correct order and if they want the other item back to send you a postage paid packing box. If they dont or wont, do a chargeback and keep the boxset.
OK, maybe calling them muppets was a bit harsh They responded within 5 hours, so not bad going there.
It's just the kid in me disappointed that my remote control toy hasn't turned up
I think I will ask them to send me a pre-paid box and ask for what I ordered.
Last year I ordered Gladiator on DVD, they sent me one on the Karma Sutra for those of a mature age, that was more funny than disappointing!
By sending you the wrong item, they have sent you an "unsolicited item". Unsolicited items do not need to be paid for by law, so under current legislation you can demand the item that you paid for AND keep the unsolicited item free of charge.
So if they won't refund your postage in FULL, then quote the "unsolicited item" legislation to them, and demand your original order.
It might not work, but technically you'd be in the right.
Under the Unsolicited Goods and Services Act 1971, (as amended) it is an offence to demand payment for goods known to be unsolicited, in other words, they were sent to a person without any prior request made by them or on their behalf.
Someone who receives goods in these circumstances may retain them as an unconditional gift, and does not have to pay for or return any unwanted goods. Anyone who receives a demand for payment for unsolicited goods should report the matter to their local Trading Standards Department.
However, in the case of unsolicited goods received before 1 November 2000, the recipient is required to give notice to the sender to collect them within 30 days, or otherwise to wait for 6 months, before being able to treat the goods as their own property.

Funny you should mention Play sending out the wrong items, I recently ordered LV season 2 from them and they sent me Nightmare on Elm Street boxset :?

Nah, not for me. I`m in Norway ("I`m a viking. I rape and pillage etc. etc.") and I had to send it by registered post (or so HMV recommended at least). And with the norwegian postage-rates nowadays it cost £8.50 for a single CD...
But HMVs CS did say they would refund the postagecosts :)
